My Baby’s First Year Experience – Terms & Conditions
(These terms should be read alongside the standard terms and conditions provided by Yellow Blossom Photography below)
Package Overview
The My Baby’s First Year Experience includes four (4) photography sessions:
- Maternity
- Newborn
- Sitter (approximately 6–8 months)
- First Birthday
If the maternity session is not required (for example, if your baby has already been born or you are past 36 weeks pregnant), it may be exchanged for either a family session or a second birthday session.
Session Inclusions
- Maternity Session – Three (3) digital images and one matching 12x8" mounted print of 1 of the 3 images
- All Other Sessions – One (1) 12×8" mounted print and a matching digital image
These inclusions form part of your experience and cannot be exchanged, substituted, or redeemed for cash or credit. Additional images and products are available to purchase separately but are entirely optional, and there is no obligation to purchase beyond what is included in this experience.
Retainer Fee
A retainer fee is required to secure your four-session experience. Following the statutory 14-day cooling-off period, this fee is non-refundable. To protect the integrity of the full-year package, this fee cannot be used as credit for early individual sessions. It will be held on your account and is redeemable only as a £95 credit toward your 4th and final session purchase, or applied immediately toward a full collection package upgrade over all 4 sessions. If you fail to attend or complete all four scheduled sessions, the booking fee is completely forfeited to cover studio time.
Your Right to Cancel (Cooling-Off Period)
You have the right to cancel your booking within 14 days of purchase and receive a full refund, provided no session has taken place. If you choose to attend your first session within this 14-day period, you agree that services have begun and your right to cancel is waived.
Your Right to Cancel (The Journey)
You are within your rights to cancel your participation in the Journey at any time. However, please note that upon cancellation, any future sessions remaining in the package will be immediately forfeited.
Furthermore, all digital images, physical prints, studio credits, promotional vouchers, or gifts accrued or included as part of the Journey package will be forfeited and marked as unusable. No partial refunds or pro-rata credits will be issued for elements of the Journey not undertaken.
Rescheduling
Each session may be rescheduled once free of charge with at least 48 hours’ notice.
Additional reschedules may incur a £95 fee per session.
Less than 48 hours’ notice may result in the session being deducted from your package and treated as a missed session.
Attendance Requirement
To preserve the timeline of your baby's first year, all four milestone sessions must be completed in order. Sessions cannot be skipped or taken out of sequence. Missing a milestone without prior studio approval will cause the remainder of your multi-session package to be cancelled. If a session is missed and the package is terminated, all remaining studio dates and your upfront booking fee are completely forfeited.
Validity
All sessions must be completed within 24 months of your first session.
Unused or missed sessions will expire and are non-refundable.
Non-Transferable
This experience:
- Cannot be transferred to another person
- Cannot be resold or shared
- Cannot be exchanged for cash
Any credit issued has no cash value and is non-refundable.
Image Storage
Final images will be stored for a minimum of 1 month after delivery. After this time, images may be permanently deleted and cannot be guaranteed unless additional storage has been purchased.
Additional storage services are provided for as long as Yellow Blossom Photography remains in business. Should the company cease trading, you will be informed and will be responsible for downloading and securely storing your own images.
While all reasonable care is taken in the storage of your images, no liability is accepted for loss or damage to digital files once the minimum storage period has passed or where images have not been downloaded by the client.
Additional Terms
All sessions are subject to standard session terms and conditions, which will be provided in full at the time of booking. These include details on session preparation, image delivery, editing style, and studio policies.
All images are created in a consistent artistic style that reflects the brand, and final images are delivered at the photographer’s discretion.
Liability
Nothing in these terms limits or excludes liability where it would be unlawful to do so.
In all other circumstances, liability is limited to the value of the booking fee paid.
Your Rights
Nothing in these terms affects your statutory rights under UK consumer law, including the Consumer Rights Act 2015.
In-House Payment Plan Terms
In-house payment plans are offered as a convenience and are interest-free. They do not change the overall package price. By entering into a payment plan, the client agrees to sign a separate payment plan agreement outlining all details and enters into a legally binding commitment to complete all scheduled payments in full over the agreed term.
Payment instalments are due on the agreed dates and are collected via direct debit. A 5-day grace period applies to each instalment. Any payment not successfully collected within this period will incur a £25 late payment administration fee to cover additional processing and follow-up.
Digital images, prints, and products will be delivered as outlined in the chosen collection. Delivery of images or products does not constitute settlement of the balance. In the event of missed, failed, or cancelled payments, the client remains fully liable for the outstanding balance. Two missed payments during the term of the agreement will result in the remaining balance becoming immediately due and payable in full.
Payment plans are non-transferable and non-cancellable once the client has received their online gallery and/or confirmed or requested any products included within the purchased package. No refunds will be issued for payments already made.
Yellow Blossom Photography reserves the right to take formal recovery action in respect of any unpaid balance, including but not limited to debt recovery procedures, legal proceedings, and the recovery of associated costs, in accordance with UK law.
Additional Information
- Please note that all digital screens display colour differently, so the colours you see online may vary slightly from the final printed product.
- Clients are responsible for checking and submitting the correct file names for all orders.
- Printed products can be collected by arrangement or posted for an additional delivery charge.
- To protect my work, all online galleries contain watermarking. Copyright remains the property of Yellow Blossom Photography at all times, including after images are purchased. Images are licensed for personal use only. If you require use of any images for business or commercial purposes, please get in touch to arrange the appropriate commercial licence.
TERMS & CONDITIONS
1. RETAINER/SESSION FEES
1.1. A session fee is required at the time of booking. This fee acts as a booking retainer to secure your chosen date and covers all pre-session planning, preparation, administrative work, loss of availability to other clients, and any materials required for your session.
1.2. The session fee is refundable if at least 14 days’ notice is given prior to the scheduled session date. After this time, the session fee becomes non-refundable to cover time spent, loss of availability, and any materials ordered in preparation for the session. However, the session may be rescheduled once, provided a minimum of 72 hours’ notice is given before the session start time.
1.3. No refunds, discounts, or reshoots will be offered where a client has requested a reduced gallery size in advance (as indicated within the pre-session questionnaire) to simplify image selection and is subsequently dissatisfied with the lower number of final images.
1.4. No refunds, discounts, or reshoots will be provided where the session duration is shorter or longer than originally scheduled. Session times are approximate, and the photographer retains full discretion over the duration required to capture and complete the necessary images, provided the service is delivered with reasonable care and skill.
1.5. Pricing information is made available within the pre-session questionnaire prior to payment, and clients may request the full price guide before booking. It is the client’s responsibility to review all pricing before committing to a session.
1.6. There is no obligation or pressure to purchase any additional images or products beyond what is included in the booked session (1 digital image and 1 matching print).
1.7. Outdoor Sessions: Outdoor sessions are weather-dependent. In the event of severe or unsuitable weather conditions, including but not limited to heavy rain or dangerously high winds, the photographer reserves the right to cancel or postpone the session at their discretion in the interest of safety and image quality. Where a session cannot proceed due to such conditions, the client will be offered an alternative date. If a suitable alternative date cannot be agreed, a full refund of the session fee will be issued. Weather conditions such as overcast skies, light wind, cooler temperatures, or lack of sunshine are not considered unsuitable for outdoor sessions. In these circumstances, the session will proceed as planned and standard terms and conditions, including cancellation and rescheduling policies, will apply.
1.8. Maternity & Newborn Bookings: Should medical complications arise during pregnancy which prevent your session from taking place, a full refund of the session fee will be issued.
1.9. Cake Smash Sessions: Where a cake is included as part of your session, a minimum of 14 days’ notice is required for cancellations. Cancellations made within this 7-day period will incur the full cake and decoration cost (£45), which is non-refundable.
1.10. If you choose to reschedule your session and require a new cake, a £45 cake re-ordering fee will apply.
1.11. Clients must inform Yellow Blossom Photography of any allergies or dietary requirements prior to their cake smash session. While every effort is made to ensure information is correct, Yellow Blossom Photography cannot accept liability for any allergic reactions or adverse health events resulting from the provided cake. Clients are welcome to provide their own cake if preferred, subject to prior notice on the pre-session questionnaire.
1.12 It is important that all participants, particularly children, are in good health on the day of the session. The photographer reserves the right to postpone or cancel the session where there are any concerns relating to health or safety.
2. SESSION INFORMATION
2.1. Clients will receive a short pre-session questionnaire to assist with planning and ensure a personalised experience. This must be completed no later than 14 working days prior to the scheduled session. If submitted later, the photographer cannot guarantee that all preferences or details noted will be fulfilled.
2.2. Any specific creative requests - such as themes, props, poses, or special styling requirements - must be communicated at least 14 calendar days in advance of your session. While every effort will be made to accommodate later requests, they cannot be guaranteed due to planning and sourcing constraints.
2.3. Clients are required to arrive promptly at the scheduled session time. Any delay in arrival will be deducted from the overall session time and may impact the number of final images delivered. A delay exceeding 10 minutes may result in the session being cancelled and treated as a no-show, in which case a new booking and session fee will be required. No time extensions, free re-shoots, or complimentary sessions will be offered in the event of late arrival. Clients wishing to reschedule under such circumstances must rebook a new session and pay the applicable fees in full.
2.4. Editing turnaround is typically within 21 working days, unless otherwise notified due to illness or high seasonal workload. While every effort is made to meet the estimated delivery time, no refunds, discounts, or compensation will be issued in the event of a delay.
2.5. The session duration will be confirmed at the time of booking and covers the full appointment – including arrival, outfit changes, and any breaks (where applicable). Any delays or overruns caused by the client may reduce the shooting time available. If additional time is requested, this can be added – subject to availability – at £60 for 30 minutes or £95 per hour, and must be paid at the time before the session continues. No refunds, discounts, or compensation will be provided for any time lost due to late arrival or other client-related delays.
2.6. The number of final edited images or products included in your session may vary depending on the cooperation of the subjects on the day and any specific requests for “must-have” shots. Certain images may take longer to achieve (for example, an awake baby in a basket compared to a settled, professionally posed sleeping baby). Additional images or products may be purchased at the current studio rates. The photographer reserves the right to select the best images from the session for editing and delivery.
2.7. Bookings must be made by individuals aged 18 or over. For sessions involving minors, a parent or legal guardian must be present for the duration of the session.
2.8. If clients bring personal items, props, or heirlooms to the session, they do so at their own risk. Yellow Blossom Photography accepts no responsibility for damage or loss of these items.
2.9. A photography session includes the shooting time, post-processing, and any items specified at the time of booking. Additional printed products, extra edits, or digital images beyond those included in your session are optional add-ons and will be charged separately.
2.10. Your session will begin at the scheduled time, not arrival time. Late arrival will reduce your shooting time and may affect the number of final images delivered.
2.11. Clients should arrive no more than 10 minutes before their scheduled session time, unless otherwise agreed in advance. Early arrivals may be asked to wait outside or return at the scheduled time to avoid disrupting ongoing sessions or setup.
2.12. While the photographer will always do their best to capture a full and varied gallery, only the best images will be carefully selected and edited at their professional discretion. Unedited or unselected images will not be available for viewing, and the photographer will not revisit image files to locate alternatives. No 100% guarantees are made regarding the delivery of a minimum or maximum number of images, and the photographer is not liable if these estimates are not met. This process ensures delivery of high-quality, consistent images in line with the photographer’s style and standards.
2.13. If third-party professionals (e.g., makeup artists, stylists) are involved in your session, Yellow Blossom Photography is not responsible for the quality, timing, or outcomes of their services.
2.14. By booking, clients acknowledge they are familiar with and accept the photographer’s artistic style and editing approach. Requests for stylistic deviation may not be accommodated.
3. PAYMENT TERMS
3.1. Full payment for the session is required to book your slot.
3.2. Accepted payment methods include debit/credit card, bank transfer, in-house payment plans and approved third-party payment platforms such as Klarna and Clearpay.
3.3. Where Klarna or Clearpay is used, clients are responsible for reviewing and adhering to the payment terms, schedules, and conditions as outlined in those providers’ own policies. Yellow Blossom Photography accepts no responsibility for disputes, missed payments, or additional charges incurred through use of these services.
4. DIGITAL IMAGE USE & ONLINE GALLERY
4.1. Unauthorised use of online gallery images - including but not limited to taking screenshots, removing watermarks, or using paid third-party services or AI tools to alter or extract images - is strictly prohibited and constitutes a breach of copyright. Such actions will result in legal proceedings.
4.2. Watermarked online preview images are for viewing purposes only. Only images that have been purchased may be legally downloaded, used, or shared. Any attempt to obtain, screenshot, edit, remove watermarks from, or distribute images without proper purchase and permission constitutes copyright infringement and theft. Legal action will be taken against any unauthorised use.
4.3. Online galleries will remain available for up to 5 working days for image and product selection. After this period, images will be archived, and further viewing will only be possible by booking an in-studio ordering appointment at a cost of £95. This fee will be deducted from your final purchase. If no purchase is made during the appointment, the £95 is non-refundable, as it covers the photographer’s time and the studio running costs required to open for your appointment.
4.4. Galleries are hosted on a third-party platform, and while every effort is made to maintain access and stability, Yellow Blossom Photography is not responsible for any technical errors, outages, or data loss caused by the hosting provider. In the rare event that a gallery is removed or becomes inaccessible due to a system failure, Yellow Blossom Photography cannot be held liable for lost images.
4.5. Clients are responsible for downloading and safely backing up any purchased files upon delivery. Yellow Blossom Photography does not provide ongoing backup services, and no refunds, re-edits, or re-shoots will be offered where a client has failed to take reasonable steps to secure their files.
4.6. Yellow Blossom Photography is under no obligation to retain session files beyond 30 days after gallery expiry and all images are removed from the system.
4.7. All gallery access and image download activity is automatically recorded for security and copyright protection purposes. This data may be used in the event of unauthorised usage, download disputes, or suspected breach of terms. By accessing the gallery, you consent to this monitoring.
4.8. Once your gallery has expired, access to images may be permanently lost unless a lifetime backup or reactivation has been arranged in advance.
4.9. Lifetime Storage – If you have purchased this service, or if your session package includes lifetime storage, Yellow Blossom Photography will store your images for as long as the business continues to operate. Images will be stored online via the studio’s website platform (Pixieset) and an additional backup copy will be kept on an external hard drive securely stored. Clients are responsible for keeping their own backups of all purchased files. Yellow Blossom Photography accepts no liability and offers no refunds or compensation in the event the business closes.
5. POSING & SAFETY
The safety of all clients, particularly newborns and children, is the photographer’s utmost priority. Any poses considered to pose a risk to the child’s safety will not be conducted. The photographer reserves the right to refuse specific poses accordingly.
6. PRINTING SERVICES
6.1. Clients are encouraged to use Yellow Blossom Photography’s printing service to ensure quality and colour accuracy.
6.2. If third-party printers are used, Yellow Blossom Photography accepts no responsibility for print quality, cropping issues, or colour discrepancies.
6.3. No refunds or re-edits will be offered for poor print results from third-party services.
7. PRINTED PRODUCTS
7.1. Printed products have an estimated production timeframe of approximately 4 weeks from the date full payment is received, or from the date a payment plan is set up.
7.2. Products may be collected (via appointment only), posted (additional cost), or delivered within a 5-mile radius at no extra charge.
7.3. Items not collected within 3 months of notification of completion may be disposed of or donated at the company’s discretion, with no entitlement to refund or replacement.
7.4. Lifetime Guarantee – Printed Products
All printed products supplied by Yellow Blossom Photography include a lifetime guarantee against fading, discolouration, or manufacturing/material defects, provided they are stored, handled correctly. This guarantee does not cover damage resulting from improper handling, exposure to extreme temperatures, moisture, direct sunlight, or other environmental factors, nor accidental or intentional damage. In the event of a valid claim, a replacement will be issued at no additional cost to the client.
8. PETS
8.1. Clients must notify the photographer in advance if they intend to bring a pet.
8.2. In the event that an animal displays aggressive, unmanageable, or disruptive behaviour, Yellow Blossom Photography reserves the right to cancel the session immediately on safety grounds. No refunds, re-shoots, or complimentary sessions will be offered in such circumstances.
8.3. Any accidents caused by pets (e.g., urination/defecation) will incur a £65 cleaning fee to cover professional services. Clients must take all reasonable steps to prevent such incidents. If the accident results in the cancellation or delay of subsequent bookings, the client will also be held liable for any associated loss of income or damages.
8.4. Owners are solely responsible for the behaviour and safety of their pets. Yellow Blossom Photography will not be held liable for any injury or damage caused by animals brought to the session.
9. ADDITIONAL CHARGES
9.1. The following optional services are available upon request and will incur additional fees:
- RAW or unedited JPG files: £195 per image
- Background changes: £95 per image
- Portrait touch-ups (e.g. skin smoothing, stray hair removal, blemish correction): £45 per image
- Full image re-edits (including changes to lighting, colour grading, or composition): £195 per image
- Face Swaps: £45 per person per image
- Removing/adding items: £75 per image
9.2. Retouching will be completed in the photographer’s established editing style. Requests for significant body alterations, cosmetic changes, or style departures may be declined or incur additional fees at the photographer’s discretion.
9.3. All additional edits must be requested within 3 days of receiving your final image. Any requests made after this period may be subject to extended turnaround times or refusal.
10. CANCELLATIONS & RESCHEDULING
10.1. Cancellations or requests to reschedule must be made by direct contact via telephone on 07845 957035.
10.2. Outdoor sessions are weather-dependent. 10.3. The session fee is refundable where at least 14 days’ notice is given prior to the scheduled session date.
10.4. Where more than 72 hours’ notice is given but less than 14 days, the session fee is non-refundable, however one reschedule is permitted at no additional charge, subject to availability.
10.5. A second request to reschedule will require payment of a new session fee.
10.6. Where less than 72 hours’ notice is given, the session fee is non-refundable and a new session fee will be required to secure a new booking.
10.7. If Yellow Blossom Photography is unable to fulfil the booking (for example due to illness or unforeseen circumstances), a full refund or alternative session date will be offered, subject to availability.
10.8. Yellow Blossom Photography reserves the right to postpone a session where there are reasonable concerns relating to health or safety. In such cases, the session will be rescheduled at no additional cost.
10.9. Yellow Blossom Photography shall not be liable for any failure or delay in performance of obligations where such failure is due to circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, power outages, or acts of government. In such cases, sessions will be rescheduled at no additional cost.
11. REFUNDS
11.1 Refunds are not offered on the basis of client dissatisfaction with the final images, provided the services have been delivered with reasonable care and skill. Clients are responsible for reviewing the photographer’s portfolio prior to booking to ensure the style meets their expectations.
11.2 Minor corrections that are outside the client’s control, such as backdrop creases, colour banding, and visible lint or fluff on props/backdrops, are included as standard. Requests for additional edits (including but not limited to background changes, face swaps, removal or addition of elements, or full image re-edits) may be declined or will incur additional charges as outlined in Section 9.
11.3 No refunds, re-edits, or reshoots will be provided for dissatisfaction arising from factors outside the photographer’s control, including (but not limited to) participant cooperation, personal appearance, forgotten items, or dissatisfaction with props, set-up, or styling where these have been agreed or selected in advance.
11.4 No refunds or discounts will be offered in the event of late arrival, reduced session time due to lateness, or failure to attend the scheduled session.
11.5 No refunds, discounts, or reshoots will be offered where a client has requested a reduced gallery size in advance (as indicated within the pre-session questionnaire) to simplify image selection.
11.6 Clients acknowledge that Yellow Blossom Photography maintains a consistent photographic and editing style, as demonstrated within the portfolio. Requests for stylistic changes that deviate from this style may be declined or subject to additional charges.
11.7 Any concerns or complaints regarding your session or images must be raised in writing within 7 calendar days of receiving your gallery. Yellow Blossom Photography will not be liable for complaints raised after this period.
12. LIABILITY & DAMAGES
12.1. Yellow Blossom Photography accepts no liability for any injury, accident, allergic reaction or loss sustained by clients while on the premises. Clients must inform the photographer of any allergies prior to the session. (See Section 1.7.)
12.2. Parents and guardians are fully responsible for the supervision and behaviour of all minors and animals in their care throughout the session.
12.3. Any damage to props, equipment, or the premises caused by clients or their companions will be chargeable to the client in full.
12.4. Clients must inform the photographer if they or any participants are unwell prior to the session. Yellow Blossom Photography reserves the right to postpone any session where health and safety may be compromised.
12.5. Yellow Blossom Photography reserves the right to immediately end a session if a client or guest behaves in a threatening, abusive, or inappropriate manner. No refunds will be issued under such circumstances.
13. COPYRIGHT & USAGE
13.1. All photographs remain the intellectual property and copyright of Yellow Blossom Photography at all times, including after full payment has been made by the client. Payment grants the client a personal, non-commercial licence to use the purchased images in accordance with these terms and conditions.
13.2. Clients may not alter, edit, sell, or use images for business or unlawful purposes.
13.3. By booking a session, the client grants Yellow Blossom Photography permission to use any image from the session for promotional purposes unless a written objection is received before the session date.
13.4. Images may not be used for commercial gain, including but not limited to advertising, resale, or promotional use, without prior written consent and a commercial licence agreement.
13.5. Where the session consent to use images involves minors, a parent or legal guardian must provide written consent for images to be taken and used. This consent will be obtained via a signed model release at your session.
13.6. Clients may not use artificial intelligence (AI) tools or editing software to alter, reprocess, or generate derivative works from any images provided by Yellow Blossom Photography without express written permission.
14. DATA PROTECTION
14.1. Client personal data (e.g. name, contact information, booking details) will be stored securely and used solely for the purposes of providing photographic services.
14.2. Your data will never be sold or shared with third parties, except where required to fulfil services (e.g. delivering printed products).
14.3. You may request access to, correction of, or deletion of your personal data at any time.
15. MODEL CALLS & PROMOTIONAL SESSIONS
Sessions offered under model calls, promotional offers, or portfolio-building opportunities may be subject to separate terms. These sessions typically include limited image delivery, fixed styling or themes, and a full model release. Clients will be required to sign a specific agreement for such sessions. Standard T&Cs may not apply in full.
16. GIFT VOUCHERS
Gift vouchers are valid for 12 months from the date of purchase unless otherwise stated. They are non-refundable once purcahsed and cannot be exchanged for cash. Lost or stolen vouchers cannot be replaced.
17. FINAL AGREEMENT
17.1. These terms and conditions represent the entire agreement between Yellow Blossom Photography and the client.
17.2. Yellow Blossom Photography reserves the right to update or amend these terms and conditions, as well as session pricing, packages, and fees, at any time without prior notice.
17.3 Yellow Blossom Photography is a trading name of Yellow Blossom Designs Ltd, a company registered in England and Wales under Company Number 8450206. The registered office address is 82B High Street, Cambridge, CB22 3HJ.
18. COMMUNICATION & MAILING LIST
18.1. By contacting Yellow Blossom Photography - including through enquiry forms, email, phone, or social media messaging - you consent to being added to our mailing list. This allows us to send important updates, session information, promotions, and relevant content related to our services.
18.2. You may opt out of non-essential communications at any time by clicking the “unsubscribe” link in any email or by contacting us directly.
18.3. We respect your privacy and will never sell or share your data with third parties for marketing purposes. For more information on how your data is used and protected, please refer to Section 14: Data Protection.
